The problem for Toyota is the inadmissibility of appeals for post-race 25-second penalties, because if the incident had occurred earlier in the race, the penalty would have taken the form of a drive-through, which is not subject to appeal.

Toyota snuck in its appeal through a loophole, by lodging it not with the stewards of the meeting, but with the local clerk of the course.

The team has two days to formalise its appeal in writing.

If it allows the procedure, the Court of Appeal would be faced with a difficult decision. Hamilton has been quoted by Speed TV as admitting that - after passing Trulli following the Toyota's off - he was then "told (by McLaren) to let him back past."

Hamilton presumably then pulled over and slowed, which would seem to corroborate Trulli's explanation that he only passed the Briton because "there was nothing else I could do."


This should be interesting.

Jenson Button's victory in the opening Grand Prix of the 2009 season in Australia was close to perfection.

One locked brake on cold tyres behind the safety car and arriving into his pit stop in the wrong gear is all he could have improved on, which sums it up.

He was under pressure for the whole 58 laps of the race at Albert Park and was never able to relax.

It might have looked like an easy win for Button in his shiny new Brawn Grand Prix car but it certainly was not a cruise.

Jenson can come across as a bit of a jack the lad but he's an intense and determined driver who hides his emotions well

Red Bull's Sebastian Vettel was pushing him hard before he collided with Robert Kubica's BMW Sauber in the closing stages. It was the fast-closing Kubica who was the real threat in the latter part of the race.

Button also had to deal with the late afternoon low sun bouncing off the track and two safety car restarts.

The Englishman showed how mentally strong he is and that he can deal with pressure and expectation on his shoulders.

Button is a regular guy and I suspect he carries some frustrations and self-doubt. He has taken quite a pounding during his Formula 1 career.

Yes, he can come across as quite confident and a bit of a jack the lad but underneath all that he is an intense and determined driver who hides his emotions well.

His team-mate Rubens Barrichello, who finished second to complete the one-two for Brawn, summed it up for both of them when he said: "You have to be ready for the circle of life so that when you are on top of the circle and things are going your way, you can make the most of it."


The Brawn car was impressively quick throughout the Melbourne weekend
Button and Barrichello have been hanging around struggling to survive, driving for two years with a difficult Honda car before the team morphed into Brawn.

The worrying thing about Button and the super-fast Brawn's victory is the question it raises about the importance of driver ability versus car performance.

Observers might be thinking: "Hang on, if world champion Lewis Hamilton was struggling for pace and Button came from nowhere to take pole and win the race isn't it just about the car?"

The whole field of drivers are no more than half a second per lap apart but the best drivers almost always end up in the best cars. However, clearly they can't defy the laws of physics - if their car lacks power or grip then they cannot make up the difference.

The car is a pivotal factor, especially this year with such wide-ranging regulation changes.

The Brawn is definitely a strong car - Barrichello did his best to shovel others off the track in Melbourne but extraordinarily the front wing and front suspension absorbed it all.

The worst thing that could have happened in Australia was for the Brawn to clear off into the distance and wipe the floor with the rest of the field

The Brawns also found a way to make the tricky 'super-soft' tyres work.

They give better grip than the 'medium' tyres for the initial couple of laps but then go off quickly.

That is why Button, like most of the drivers, had saved the super-softs for a short stint at the end of the race when the deficit would be limited because more rubber had been laid down.

Kubica and BMW, among others, tried the different tactic of getting the super-softs out of the way early to try to make up ground in the first couple of laps and then ensure they would be quick at the end of the race on the mediums.

That's why Kubica was so much of a threat in the closing laps.


Will Brawn and Button be getting used to this taste this year?
Nevertheless, while the likes of Nico Rosberg's Williams disappeared backwards when he was on the super-soft tyres, Button was still pumping the lap times in.

Brawn have some nice aerodynamic tweaks and tricks underneath the car as well as their controversial double diffuser.

That diffuser, along with a similar design incorporated by Toyota and Williams, was the subject of a protest by Ferrari, Renault and Red Bull during the Grand Prix event.

The sport's governing body, the FIA, gave the design the green light but we will find out once and for all it is legal at an appeal hearing on 14 April.

The worst thing that could have happened in Australia was for the Brawn to clear off into the distance and wipe the floor with the rest of the field.

Then, fingers would have been pointed again at the diffuser and the appeal hearing could well have been swung by an inclination to slow down the Brawns.


Having said all that, Button is very smooth behind the wheel and has a very elegant driving style, almost as if he is turning the steering wheel through treacle.

He is precise and calm and doesn't let the car move around. That style can hurt him when more aggressive driving is called for but his fluidity really paid dividends in Australia.

For repassing the McLaren, the Toyota driver was handed with a 25-second time penalty which resulted in him losing both his podium position and indeed any chance of points, as the tightly packed field finished the race under the safety car. As Toyota withdrew what would be a seemingly hopeless appeal this week, Trulli reminded onlookers of his version of events: "When the safety car came out towards the end of the race, Lewis Hamilton passed me but soon after he suddenly slowed down and pulled over to the side of the road. I thought he had a problem, so I overtook him as there was nothing else I could do."

Hamilton admitted to passing the Toyota as it ran across the grass at Turn 15, subsequently explaining that his team then instructed him to yield to Trulli. "I was behind Trulli under the safety car, and clearly you're not allowed to overtake under the safety car but he went off in the second to last corner," he explained to SpeedTV on Sunday. "He went wide and onto the grass, I guess his tyres were cold. I slowed down as much as I could, but was forced to go by. I was then told to let him back past, but I don't know if that's in the regulations and, if it isn't, I should really have had third."

Despite those comments, however, the stewards claim that Hamilton made no mention of this during their post-race investigation into the incident just minutes later, stating that he infact did not slow down to allow the Toyota to retake the place. Having received a recording of McLaren's radio broadcast during the race, the FIA has removed entire team from the final results of the race for providing 'deliberately misleading' information. This includes the second driver, Heikki Kovalainen, who will effectively not suffer the consequences having retired at the end of the first lap.

The governing body has also lifted Trulli's penalty, which places the Toyota driver back into the third position he originally achieved in Australia.



Second most recent occurrence of an element of dishonesty on the part of Team McLaren ... hmmm

apparently Hammi was misleading to the race debriefing team after the season opener and beside facing the boot from points for the driver he may face other penalties for his failure to accurately report on the events which transpired prior to debriefing.

Source: BBC radio telecast, where a sample of Hamilton's communication with his team was recorded and played for all to hear.

Why PF1 Is Still Using The Word 'Allegedly'
Thursday 2nd April 2009

The FIA have once again played with F1's results, meaning to the average fan there is not point in watching the race - you can rather tune in a week later to find what result the FIA have chosen...


* This is a disaster for the image of the sport - if not the sport itself.


As a described sport, F1 is an activity that should be won and lost in a sporting arena. A courtroom is not part of that arena and if the men in suits are to rewrite the results of a sporting occasion then it should only be as a last resort, with reluctance and in the most extreme of circumstances.


The problem F1 has in maintaining its claim to still be regarded as a sport is that, having set the tone for interference and revision on Saturday night in Melbourne when both Toyotas were excluded from qualifying, two separate changes to Sunday's result have since been forthcoming. And a third may yet follow with a FIA hearing due on April 14 to consider the legality of 'The Diffuser Three'.


What sort of sport can this claim to be? F1 seems intent on falling over a cliff into deep and dark waters.



* PF1 made a similar observation when Hamilton was excluded from the Belgian GP on the opinion of three stewards. It also lamented the contempt with which F1 supporters had been treated by a three-paragraph statement that the FIA deemed sufficient for the task of both informing and explaining their ruling.


Seven months later, nothing's changed, nothing's been learnt.


Once again, F1 supporters are floundering in the dark, feeding on pathetic scraps. The latest missive from the stewards' room tells us of disqualification, cites the relevant clause of the rulebook and claims the crime of 'misleading evidence'. But nothing else. What this misleading evidence is (or was) remains a great and unacceptable unknown. Read closely, the stewards' statement is vague on whether it was Hamilton or McLaren (or both) who provided the misleading evidence.


If the FIA, through their race stewards, are to tamper retrospectively with race results then they have a duty, as custodians off the sport, to provide full explanations; and as followers of the sport, F1 fans have a right to expect as much.


Instead, we're still as much as in the dark as we were in Spa last year. In the absence of clarity, a dark cloud hangs over F1 and a febrile atmosphere in which conjecture, paranoia and slander can pervade has been allowed to fester.



* "The Stewards having considered the new elements presented to them from the 2009 Australian Formula One Grand Prix, consider that driver No 1 Lewis Hamilton and the competitor Vodafone McLaren Mercedes acted in a manner prejudicial to the conduct of the event by providing evidence deliberately misleading to the Stewards at the hearing on Sunday 29th March 2009, a breach of Article 151c of the International Sporting Code."


In the absence of further information, the invetable reading of that statement will be the conclusion that the FIA have adjudged Hamilton and/or McLaren to be akin to a liar. And that's putting it mildly.


Even beyond the obvious implications of that judgement from a sporting perspective, the repercussions of such a ruling are massive. To question a man's integrity is one thing; to damn it is quite another. This story will not end here. Given the damage this ruling will apply to Hamilton's reputation both as a sportsman and a man, it can not end here.


If the FIA is willing to make such a judgement then it is beholden upon them to permit Hamilton an attempt to clear his name (if this is what he chooses to do). Even if they do not, they may have no choice but to defend their ruling in another type of court room.



* And it is for that reason that the FIA have no option but to issue full transcripts and recordings of their two hearings as well as explain, definitively, what exactly persuaded them to conclude that Hamilton and/or McLaren had provided misleading evidence.


As far as PF1 is concerned, and we're not an especially righteous website, Hamilton and McLaren have been found guilty of allegedly providing misleading evidence. Until evidence is provided that proves the FIA's case, anything less would break one of the most fundamental principles in law.
